A WAITRESS has sued her employer for nonpayment of overtime and breach of written contract.Liya Liu through attorney Ramon Quichocho filed a complaint in federal ourt against Xu Lan Corp., Gui Lan Xu and defendants identified only as Does 1-3.
The complaint stated that Liya Liu was recruited in China in 2004.
She arrived here on Feb. 17, 2005 and began working for Xu Lan Corp., which was doing business as Penguin II.
Liya Liu paid a total of $5,000 to the employer in recruitment and job vacancy announcement fees.
She said her employer deducted a total of $800 monthly from her salary from March 2005 to June 2005.
Liya Liu was hired as a waitress but she actually worked as a hostess at the defendant’s karaoke bar.
The complaint stated that the defendant later improperly terminated Liya Liu’s contract.
She is seeking unpaid overtime at the applicable minimum wage rate for all hours worked, contract damages for breach of contract, liquidated damages, punitive damages, pre-judgment interest, post-judgment interest, attorney fees and costs, and for such other relief as the court deems just and proper.
